The following are the "Terms & Conditions" for any Event (the "Event") being administered by JAKL KIDS.

1 Anyone that registers for a JAKL KIDS event and does not show up and does not provide notice will not be able to register for future JAKL KIDS events.

1.1  Your registration entitles you to access to the Event for which you have registered. Any and all other costs associated with your attendance shall be paid solely by you and JAKL KIDS shall have no liability for such costs.

1.2  JAKL KIDS reserves the right, in our sole discretion, to change these terms and conditions or to cancel, suspend and/or modify the Event and/or Event Terms & Conditions at any time.

 1.3  By participating in the Event, you acknowledge and agree to grant JAKL KIDS the right at the Event to  record, film, live stream, photograph, or capture you and your child (Entrant) likeness in any media available or hereafter developed and to distribute, broadcast, use, in perpetuity, such media without any further approval from you or any payment to you. This grant to JAKL KIDS includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media. Participants also agree(s) that his/her name may be used in any and all forms of media, without any further compensation by JAKL KIDS and waives all rights (including moral rights) with respect to printed and other forms of publicity. Participants may not record or broadcast any audio or video during or from any JAKL KIDS event.

1.4  You acknowledge and agree that JAKL KIDS, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, prizes, fees, hosts, moderators, venue, and time. All JAKL KIDS Pokemon Events are subject to cancellation up to 48 hours prior to the event start time if the minimum required number of participants is not met by this time. Any registration fee's paid for an event cancelled by JAKL KIDS will be 100% refunded with no deduction or penalty.

1.5  Cancellations. Participants that do not show up for or cancel registraiton to any event will forfeit the registration fee paid and, any and all materials, promotial products and prizing that was part of any event.

1.6  Children are not to be left alone during the Event. Parent/Guardian must remain with their child during the entire event. Please arrive on time to check in and have your battle deck inspected. It is helpful and speeds up the check in process if participants can have their deck sorted and grouped before arrival.

1.7  Entire Agreement: Participation in the Event constitute Entrant and Entrant Parent/Guardian ("Participant") full and unconditional agreement to these terms and conditions and the Event Rules. By entering this Event, all Participants agree that all decisions related to the Event are final and binding, and that all such decisions are at the sole discretion of JAKL KIDS.

1.8 Waiver of Liability: JAKL KIDS will not be responsible or liable for: (i) any failure to receive entries due to transmission failures or other conditions beyond their reasonable control; (ii) any late, lost, misrouted or damaged transmissions or entries; (iii) any disruptions, injuries, losses or damages caused by attending an Event beyond their reasonable control; (iv) any postponement, delay or changes that may impact on the prize caused by events beyond their reasonable control; or (v) any printing or typographical errors in any materials associated with the Event; (vi) any trading, gifting or exchange of cards between participants is at the sole discretion of the participants and their parent(s) or guardian(s). JAKL KIDS will not be accountable, liable or involved with any such transactions.

1.9  Disruptive Conduct. You acknowledge and agree that JAKL KIDS reserves the right to remove you from the Event if JAKL KIDS, in its sole discretion, determines that your participation or behaviour creates a disruption or hinders the Event or the enjoyment of the Event content by other attendees.

1.10  JAKL KIDS reserves the right, in our sole discretion, to disqualify any individual or Participant we find to be actually or presenting the appearance of tampering with the entry process or the operation of the Event or to be acting in violation of these terms and conditions or in a manner that is inappropriate, unsportsmanlike, not in the best interests of the Event, or a violation of any applicable law or regulation.

1.11 Deck Construction (TCG's): Any legitimate card can be used in your deck, please note there are a lot of fake cards sold especially on the internet. If your deck contains fake cards you will be disqualified from the Event and your registration fee will not be refunded. Prize Structure: Prizes will be disclosed in the tournament registraion information and JAKL KIDS reserves the right to change prizes at any time, for any reason.

 

1.12  Payment. The payment of the applicable fee for the Event is due upon registration. If such payment is insufficient or declined for any reason, JAKL KIDS may refuse to allow you to access the Event and shall have no liability in that regard.

1.13  Once you have completed your registration, you will receive your registration confirmation by email. Please ensure that your valid email is entered correctly on the registration form. Be sure to check your junk email box too in case any of your Event email(s) are caught by spam filters.

 

1.14  JAKL KIDS gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an “as-is” basis. The views, opinions, and positions expressed by the speakers, attendees, or sponsors at the Event are theirs alone and do not necessarily reflect the views, opinions, or positions JAKL KIDS or any employee thereof. JAKL KIDS makes no representations as to accuracy, completeness, timeliness, suitability, or validity of any information presented by speakers, attendees, or sponsors at the Event and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use. 

 

1.15  Except as required by law, JAKL KIDS nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

1.16  The maximum aggregate liability of the Organizer for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to the Organizer under this Agreement.

 

1.17  Odds of winning any JAKL KIDS event will depend on the number of participants at the time of the event.

1.18  Any Prize offered is not transferable and not redeemable for cash, will not be extended under any circumstances and must be accepted as offered without substitution. Any and all prize-related expenses, including without limitation any and all federal, state, provincial and/or local taxes, shall be the sole responsibility of the Winner. The winner must pick up the prize or pay for shipping. ​
